This Privacy Policy and Terms of Service (“Agreement”) governs your use of the BioUP Wellness mobile application and related services (“Service”), operated by BioUP Wellness (“we,” “us,” or “our”).

By using the Service, you agree to this Agreement. If you do not agree, you must stop using the Service.

1. Information We Collect and How We Use It

We collect and process the following categories of information:

1.1 Information You Provide

You may provide:

  • Name, email address, phone number (if applicable)
  • Account credentials (if applicable)
  • Fitness goals and wellness preferences
  • Health-related data, including but not limited to weight, activity tracking, dietary preferences, and progress metrics

Provision of Health Data is voluntary but may be required for full functionality.

1.2 Automatically Collected Data

We automatically collect:

  • Device type, model, operating system
  • App version, configuration, and settings
  • Usage data (features used, interactions, session duration)
  • Device identifiers (installation or system identifiers)
  • Language and time zone

1.3 Log and Crash Data

In case of errors or crashes, we may collect diagnostic data such as:

  • IP address
  • Device state at time of error
  • System logs and crash reports
  • Performance and configuration data

1.4 Use of Information

We use collected information to:

  • Provide and operate the Service
  • Personalize user experience and wellness insights
  • Track and display user progress
  • Improve performance, features, and reliability
  • Diagnose and fix technical issues
  • Ensure security and prevent abuse
  • Respond to user support requests

We do not sell personal data or Health Data.

2. Legal Basis, Rights, and Data Protection

Where required by law (including GDPR and similar regulations), we process Personal Data under:

  • Contract performance (to provide the Service)
  • User consent (especially for Health Data)
  • Legitimate interests (service improvement, security, analytics)
  • Legal obligations

Your Rights

GDPR & CCPA Notice

We do not sell personal information.

3. Data Sharing, Storage, and Security

We do not sell or rent personal data.

We may share data only with trusted third-party Service Providers that support:

  • Cloud hosting and infrastructure
  • Analytics and usage tracking
  • Crash reporting and debugging
  • App functionality and maintenance

These providers are contractually required to process data only on our behalf and protect it appropriately.

We may also disclose data if required to comply with legal obligations or protect users, systems, or rights.

If BioUP Wellness undergoes a merger, acquisition, or asset transfer, user data may be transferred as part of that transaction.

We retain data only as long as necessary to provide the Service, comply with legal obligations, or resolve disputes. Users may request deletion at any time.

We implement reasonable technical and organizational security measures, but no system is completely secure.

4. Health Data Notice

The Service processes Health Data for wellness and fitness tracking purposes only.

The Service is not a medical device and does not provide medical advice, diagnosis, or treatment. All information is for general wellness purposes only and should not replace professional medical guidance.

5. Cookies and Third-Party Services

We may use cookies, SDKs, and similar technologies to:

  • Enable core app functionality
  • Analyze usage and performance
  • Improve reliability and user experience

Third-party Service Providers may process data under their own privacy policies, subject to contractual safeguards where applicable.

6. Subscriptions and Future Changes

The Service is currently free to use.

We may introduce paid subscriptions or premium features in the future. If we do:

  • Users will be notified of material changes
  • This Agreement will be updated
  • Payment processing may involve third-party providers subject to their own terms

We may update this Agreement from time to time. Continued use of the Service constitutes acceptance of changes.

7. Children’s Privacy

The Service is not intended for users under 13 (or the applicable minimum age in your jurisdiction).

We do not knowingly collect personal data from children. If we become aware of such collection, we will delete it.

8. Limitation of Liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind.

We are not liable for indirect, incidental, or consequential damages arising from use of the Service.

Some jurisdictions may not allow certain limitations, so parts of this section may not apply.
